Fairly recently, New York became the last of the 50 US states to make irretrievable breakdown a ground for divorce US courts and the Indian apex court have held "irretrievable breakdown" to mean where at least one party believes that the discord has reached a point of no return. In New York, this discord has to continue for six months. In India, for three years with a separation In the US, courts give a summary judgment on the no-fault plea and there is no trial. In India, the irretrievable breakdown ground is for a triable contested case, which could take years just as any other contested divorce case In the UK, irretrievable breakdown is the sole ground for seeking divorce. It is proved by one of five facts: 1. Adultery 2. Unreasonable behaviour 3. Desertion, which requires two years' separation 4. Two-year separation with each other's consent 5. Five-year separation without consent. Citing "unreasonable behaviour' is a method of choice for couples who want instant divorce, when no adultery is involved
